Literary traditions often focus on tragedy, whether it be personal, national, or universal. In this way, it gives the characters, author, and reader the reference point of a shared experience upon which to build a literary work. In the case of Virginia Woolf’s Mrs. Dalloway, this uniting experience was the Great War. The remnants of this conflict can be seen throughout the novel in the lives and experiences of its characters. The integral nature of tragedy in Mrs. Dalloway means that future reimaginings and reframings must also include a uniting tragic event as a means by which to create parallels and show commonalities between characters. Michael Cunningham’s The Hours includes several different timeframes that allow for historical†¦show more content†¦Rezia Warren Smith struggles with her husband’s depression, erratic behavior, and suicidal ideation, who feels adrift in his loss as if her husband no longer exists at all. Mrs. Dalloway also feels the echoes of Septimus’s life and death and in doing so confronts the limitations of doctors to treat mental health issues and even thought of her own death or suicide. Question: Discuss about theBusiness Lawfor Partnership Act. Answer: Introduction The provided statement has been explained by Ashhurst J in Lickbarrow v Mason (1787) 2 Term Rep 63, HL at 70[1], which states that in case of any instance, when two innocent persons are affected due to the activity of a third person, then the person who has helped that particular third person in conducting such activity should be liable under the Section 14 of the Partnership Act of 1982. In case of a partnership firm, the partners will also be liable to pay the amount that has been received by any of the partners. In this regard, the liability is applicable even to the partners about whom the creditor is unaware[2]. The objective of the paper is to analyze the validity of the provided statement in respect to the definition of partnership by estoppels/holding out as mentioned in the Partnership Act of 1982. In accordance with the paper objective, focus has been predominantly given to know the definition of partnership by estoppel and holding out for which relevant court cases have also been studied to know the advantages and disadvantages with the partnership by estoppels as well. Definition and Clear Identification of the Requirements of a Partnership by Estoppel/Holding Out In case a person, suppose X has been falsely being represented as a partner by Y, in presence of a third a party Z, wherein X did not deny the fact, then the law will held X as liable to repay all the liabilities or credit that are to be repaid to Z. In this case, X is partner as per the definition provided by estoppel[3]. Estoppel arises due to transactions that involve oral communication. It is not necessary to consider that the creditor always have knowledge regarding the fact that the person has been represented falsely as partner, as the same person can also be considered as partner by holding out[4]. Apparently, the requirement for partnership by estoppel is that there must be a third party, who has given credit or consignment to the partnership firm. The third party must consider a person as partner from whom he/she can claim back the liability. The person who is considered falsely as a partner should have provided a written consent or oral agreement that makes him to be considered as a partner. It is also possible that the activities of the person were of a manner that led him/her to be considered as a partner by the third party. In this situation, the law must declare the existence of a partner by estoppel/ holding out[5]. The partner according to estoppel is responsible for meeting up the liabilities of the firm and in case the liabilities do not arise, then it is mandatory to make consent to repay back the liabilities by the false partner(s). Besides, in case more than one person is considered as partners by estoppels, then they all are responsible to repay the liabilities t o the creditor[6]. In case of partner by holding out, the partners are generally aware of the false representations, still do not take any action[7] . However, in case the person declares to the thirds party in advance that he/she is not a partner, then no estoppel liability arises[8]. Thus, in this context it can be stated that the most important requirement for partnership by estoppel is that there must be an existing firm with which a creditor has performed transaction[9]. Critical Examination of the Requirements of a Partnership by Estoppel/Holding Out The requirements for partnership by estoppel have certain benefits as well as limitations. The benefit is that the creditor, who has given any consignment to the firm, is entitled to get his/her money back, which further provoke the estoppel partner to be careful in future about repeating such kind of occurrences. In this regard, an ideal example can be elaborated i.e. Leonard v. Brewer, No. 01-12-01057-CV, 2013 WL 6199572 (Tex. App.Houston [1 Dist.] Nov. 26, 2013, St, no pet.[10], in which Stephen Brewer was held liable for not paying the amount of promissory note, that was signed by the Brewer on the behalf of BW Office. There was a possibility in this case that the Brewers activities were of a kind that led the third party, Leonard to consider him as a general partner[11]. The partnership by estoppel makes it mandatory for the partners to come into a discussion, as no argument can be provided to prove the absence of partnership[12]. On the other hand there are certain limitations in the partnership of estoppel based on which it can be criticized, as in certain circumstances the nature of interaction between two parties can make a third party to recognize that the two parties are engaged in a partnership contract. In this case, the partner by estoppel is also liable to pay the dues of the third party even if he/she has forgotten the mentioned interactions. In the similar note, a case between Chavers v. Epsco, Inc.98 S.W.3d 421 (Ark. 2003), a problem had to faced by Chavers Welding and Construction (CWC) due to the partnership by estoppels, wherein it was found that the Epson Inc., provided services pertaining to human payroll to CWC on credit. The proprietor of the company was Gary Chaver and his daughter Reggie Chavers and son Mark Chavers served as employee of CWC. The representation of Mark and Reggie was of a kind that led Epson to conclude that they were partners of CWC. On the basis of the rules on partners hip by estoppel, the court gave verdict in favor of Epson that made Reggie and mark jointly pay an amount of $80,360.92 to the company. Thus, partnership by estoppel can be regarded as unfair because mere perception on behalf of the third party cannot be a basis of considering a partnership contract. The partnership by estoppel does not focus on the presence of evidences in partnership deeds that should be considered by courts while giving judgments[13]. Concerning the partnership of holding out, the individual has knowledge regarding the fact that he/she is being perceived as a partner by a third party though he/she is actually not. It gives a benefit to creditors, as they can get claim for payment from the partner by holding out, in case the actual partner fails to meet the obligations. The holding out partner cannot refuse from the obligations, since he/she did not deny this fact before even after being aware of it[14]. The O'Brien Gere Engineers, Inc. v. Taleghani, 525 F. Supp. 750 (E.D. Penn. 1981) on the other hand reveals that partnership by holding out not only focuses on paying the obligations of the creditors, but also the tax liabilities to the local and state government as well. This clearly represents the extra burden on the partners, who have been holding out[15] . Based on the discussion, it can be affirmed that the statement of Arthur J is being supported in some grounds as well as has been disagreed in certain cases. The advantage of partnership by estoppel/holding out can be elaborated based on the fact that it provides an opportunity to the creditors to claim their obligations, if the actual partner fails to do so. This however does not support the theme of the quoted sentence, as the actual partners do not suffer in case of such situations. The non-partner is unaware of the fact that the actual partner has represented him/her in the partnership deed, which influences the creditors to sue the former in case of non-payments of due. Thus, this is regarded as invalid fact, as the main responsibility of repayment of dues lies with the actual partner. Conclusion The Section 14 of the Partnership act of 1982 states about the duties that a partner of estoppel has towards the creditors. The nature of interaction of the non-partners with the actual partners leads third parties to misrepresent the fact of partnership deed. In this case, the non-partner either knows the entire matter or is unaware of it. The court however compels the partner by estoppel to repay back the dues to the third parties. From a different perspective, it is also possible that the actual partner falsely represents the name of the non-partner in the partnership deed. The requirements that are very essential for partnership of estoppel and holding out are that there must be creditor, who has performed transactions with a firm that has supported certain obligations and a non-partner must exist, who interacts with the real partner(s) and the creditor(s). The concept of the two types of partnership discussed in the paper has both benefits as well as limitations. Partnership by estoppel and holding out gives a benefit of assurance to the creditors that they can get back the obligations even if the actual partner fails to do so. However, the limitation is that the actual partners at times takes undue advantages of the unawareness of the non-partners and represent them, as partner in front of the creditor. Europeans and Pacific Islanders had a differing lifestyle when growing up that had a major influence on how and why they navigated the way in which they did. For once instance, the Pacific Islanders learned from a small age to be more curious and explore the nature around them. Europeans were living a more civilized life, so the children were not encouraged to explore nature like the Pacific Islanders were. Beginning at a young age, like 6 or 7, the Islanders would be taken on canoe rides and they were free to explore the islands and the lands that surrounded their village. Another reason for Pacific Islanders being better navigators is that they combine traditional knowledge with more personal and intimate knowledge. Europeans were relying solely on traditional knowledge for traveling. For instance, they most relied on a compass and stars to know if they were on the right track. An example of this personal knowledge is how a boat may change the way it is sailing because of how the c urrent changes. They would also note how the sky would change different colors and how to use that to detect reefs and other obstacles in it and how to read the sky. The Pacific Islanders are also more naturally experienced in traveling especially across sea. Some of that knowledge is not something that can be acquired in a traditional setting. A person still has to combine the traditional knowledge with personal experience to fully succeed. The navigators also have to have certain characteristics like keen eyes. The Pacific Islanders are taught to sometimes ignore visual cues because there will be more significant evidence such as stars or the wave patterns. These clues are difficult for a novice to pick up. One island navigator says "he would sometimes retire to the hut on his canoe's outrigger platform, where he could lie down and without distraction more readily direct the helmsman onto the proper course by analysing the roll and pitch of the vessel at it corkscrewed over the wa ves." They first sit together and try to make little diagrams with pebbles on the mats. The pebbles represents stars so at a young age. Explain Christian views on suicide Essay In a broad sense suicide can be defined as, â€Å"the act of intentionally ending your life.† However, there are many different types of suicide. Durkheim identified four kinds: egoistic suicide, which is the result of feeling one’s life is meaningless; altruistic suicide, the act of giving one’s life for the greater good; anomic suicide, the result of a major social change that disrupts a person’s sense of order; and fatalistic suicide, the results of excessive regulation, when one’s future is pitilessly blocked by oppressive discipline, such as in a prison or dictatorship. Christians believe that all life is sacred, and therefore the vast majority of denominations are against all forms of suicide. In examining the reasons behind this, a good place to start is the Christian teaching on the sacredness of human life. Christians believe in the sanctity of life, meaning that all human life is created in God’s image and has intrinsic worth. The Decalogue teaches, â€Å"Do not kill.† This includes killing oneself. Elsewhere in the Old Testament, Ecclesiastes 7:17 states, â€Å"Be not over much wicked, neither be you foolish: why should you die before your time?† Prematurely ending your life prevents the believer from serving God to his full potential. This idea is backed up in the New Testament, where the Apostle Paul writes in 1 Corinthians 3:16, â€Å"Know you not that you are the temple of God, and that the Spirit of God dwells in you?† Christians reject the idea of total bodily autonomy, meaning that they do not believe we have the right to do whatever we want with our bodies. The Bible suggests that our bodies are not our own, but God’s, and therefore we do not have the right to destroy them. Historical church fathers have held consistently negative views on suicide. Augustine was one of the first to publically speak out against it. He opposed it because we have a duty of selfà ¢care arising from natural inclination and we have a debt of love that we owe to others. In The City of God he wrote, â€Å"certainly he who kills himself is a homicide, and so much guiltier of his own death, as he was more innocent of that offence for which he doomed himself to die.† To take one’s own life into one’s hands and act precipitously by committing suicide is to look away from God (a final and definitive refusal of trust in God and a denial of trust in his providence, by the very nature of the act itself excluding any subsequent repentance/penance). Furthermore, Aquinas was also against suicide. In Summa Theologica he set forth three reasons why suicide is immoral. Firstly, it is contrary to natural law. Secondly, suicide does injury to the common good because the person’s community will suffer. Thirdly, it is a sin against God because life is God’s gift to man. For it belongs to God alone to pronounce sentence of death and life, according to Deuteronomy 32:39, â€Å"I will kill and I will make to live.† However, there is one form of suicide that some Christians would accept, and that is altruistic suicide in the form of martyrdom or self-sacrifice. Jesus taught that, â€Å"Greater love has no-one than this, that he lay down his life for his friends.† For example, in Judges Samson brings down a temple killing both himself and the Philistines. Augustine said that suicide was rooted in pride and lack of charity, whereas martyrdom is commendable and for the good of others. The different Christian denominations are generally unified when it comes to views on suicide. In the Roman Catholic Church it is regarded as a mortal sin, and the Catechism asserts, Everyone is responsible for his life before God who has given it to him. It is God who remains the sovereign Master of life.† The Presbyterian Church would hold a similar view, as the Westminster Confession reads, â€Å"The sins forbidden in the sixth commandment are, all taking away the life of ourselves, or of others, except in the case of public justice, lawful war, or necessary defence.† Even though they clearly teach that suicide is a sin, it is not an unpardonable sin. Salvation is by grace alone and if one is truly saved, nothing (not even suicide) can separate them from Jesus. The United Methodist Church believes that suicide is not the way life should end, but would be hesitant to label it a sin. Therefore, they denounce the condemnation of people who commit suicide, and do not believe surviving family should be stigmatised. Modern psychology has impacted the Christian view of suicide. In the past Christians were guilty of separating physical and mental illness and although they were in support of treatment for physical ailments, they were wary of psychiatric treatment. Even today some fundamentalist churches would see illnesses such as depression as purely spiritual afflictions. In the wake of high profile suicides such as Rick Warren’s son Matthew, most leaders are encouraging the Church to acknowledge that matters of depression and suicide are medical in nature and should be addressed no differently than other physical illnesses. They imply that to do otherwise promotes stigma, shame and restricts the believer’s access to appropriate care. Another reason why Christians are against suicide is the profound negative effect it can have on other people. Suicide does not just harm the person who dies, it is a form of bereavement even more devastating than usual because the family will forever agonise over what led the person to take their life, and if they could have prevented it. This is especially so if the family discover the body or witness the suicide. Suicide can damage close communities such as schools and churches. Wyatt said that, â€Å"suicide can have devastating effects on others. In fact, it can be one of the most selfish and destructive acts anyone can perform.†

Frederick Herzberg came up with his finding

Frederick Herzberg came up with his findings on satisfaction, which he published in his book â€Å"The Motivation to Work,† in 1959 (NetMBA [no date]). He conducted series of interviews where â€Å"employees were asked what pleased and displeased them about their work† (NetMBA [no date]). After analyzing the gathered data, he came up with the six top factors in the work environment that cause dissatisfaction, or the hygiene factors, and the top six factors that cause satisfaction, or the motivation factors.When the following factors are absent, there is dissatisfaction: (a) Company policy, (b) Supervision, (c) Relationship with Boss, (d) Work Conditions, (e) Salary, and (f) Relationship with peers (NetMBA [no date]). However, it is to be noted that the presence or maintenance of these factors does not necessarily mean satisfaction but would only mean that there is no dissatisfaction (NetMBA [no date]). If supervision will be maintained at the minimum level, it does not necessarily mean that the employee will gain satisfaction in his job. Furthermore, it could be noticed that these factors are external to the job itself and to the worker. These are things which are dependent on a lot of other things aside from the worker and the job.The factors that lead to satisfaction are as follows: (a) Achievement, (b) Recognition, (c) Work itself, (d) Responsibility, (e) Advancement, and (f) Growth (NetMBA [no date]). Similar to the factors that lead to dissatisfaction, the absence of one of these six factors does not necessarily lead to dissatisfaction but would only mean that there is no satisfaction felt.It is to be noted that Herzberg does not meant these two sets of factors to be of the opposite poles but he meant it to live on two different sticks. It is best to make an illustration of this for better understanding.Here, it is easy to pinpoint what happens when the two set of factors are present and absent or maintained and not maintained. Reading the se cond column downwards, motivating factors bring satisfaction when these are present. With their absence, no satisfaction is felt but this does not necessarily mean that the employee is dissatisfied. On the third column, when the hygiene factors are not maintained to a desired level or are absent, this leads to dissatisfaction. Their presence or maintenance, on the other hand, would bring no dissatisfaction but does not necessarily mean that satisfaction is achieved.Somehow, it gives much sense that this theory provides certain implications for management of human resources. This theory pinpoints how the level of confidence or satisfaction of employees can be boosted or how their morale, for that matter, can be placed at a higher level. The human resources manager, aided with this theory, may at the very least, be able to identify soft spots where improvements could be made for the employees to feel satisfied with their jobs.The sets of factors mentioned above could be a starting poi nt for bringing in satisfaction and for boosting the morale of the employees. More specifically, the manager could concentrate on addressing the hygiene factors and keeping it at a level that leaves no dissatisfaction for the employees and raising up the motivation factors to bring in satisfaction. This way, it could also be a precursor for higher levels of morale for the employees.Further, Herzberg did not leave the study without strategies for bringing in the much-desired satisfaction for employees. One of his suggestions was job enlargement for employees. Job enlargement, in human resource management, may be taken as the horizontal expansion of a certain job. For example, a secretary who has the job duties of answering phone calls and making appointments to clients may be given a new task of organizing the incoming and outgoing files. Giving more tasks of the same nature and would fit the job title would fall under the category of job enlargement. It is like adding more chocolate to the chocolate. This is not the same as job enrichment, which is adding the almonds and fruits to the chocolate.To this, the technique that leads to job satisfaction can be identified and is through the combination of high hygiene and high motivation (Anon. [no date]). This means eliminating the causes of dissatisfaction to a point where there is â€Å"no dissatisfaction† felt by the employees (Anon. [no date]). Subsequently, the company can inject the motivation factors to lead the people to become highly-motivated employees (Anon. [no date]).The two-factor theory of job satisfaction may have took off from and have similarities with the Hierarchy of Needs by Abraham Maslow as it also pertains to (a) physiological, (b) security and safety, (c) love and feelings of belonging, (d) competence, prestige, and esteem, (e) self-fulfillment, and (f) curiosity and the need to understand (Anon. 2005).This theory does not escape the criticisms because there are loopholes or gaps that are left unfilled. This theory does not take into consideration the fact that people may not consider the same set of hygiene and motivation factors because they might have different needs and achievements.
